Hesse: Verdict: Shisha bar operator has to pay compensation for pain and suffering

Frankfurt / Main (dpa / lhe) – The operator of a shisha bar in Hesse has to pay 6400 euros in compensation for giving a shisha to a minor. The Frankfurt am Main Higher Regional Court (OLG) confirmed a previous judgment of the regional court with a decision published on Monday (Az.: 6 U 148/21). In the specific case, the minor at the time reportedly suffered from carbon monoxide poisoning.

“The operator of a pub is obliged to behave in such a way that the body, life and other legal interests of the guests are not injured,” said the OLG publication. The plaintiff, who was underage at the time, visited the bar with a friend to smoke a shisha. She was neither asked by the employees about her age nor was she instructed in how to use the shisha. According to the protection of minors, tobacco products, for example, should not be sold to children or young people in restaurants. The Higher Regional Court emphasized that they should not be allowed to smoke or consume nicotine-containing products either. This also applies to nicotine-free products such as electronic cigarettes or electronic hookahs.
