Murcia Compensation with 72,000 euros to the parents of a one-year-old girl who died of an undetected intestinal obstruction

The Contentious Chamber of the Superior Court of Justice of the Region of Murcia (TSJRM) has condemned the Murcian Health Service (SMS) to pay 72,000 euros to the parents of a one-year-old girl who died after not detecting the obstruction in time intestinal suffering.

The sentence, to which Efe has had access, indicates that the parents directed their claim against the SMS, their insurance company and the doctor who treated the minor at the hospital where she was treated, from whom they requested compensation close to the 144,000 euros by way of patrimonial responsibility.

In their lawsuit, they stated that when the girl presented a case of vomiting, they took her to a health center, from which she was transferred to the hospital, where she continued in the same situation, although the doctor who attended her told them that it was normal, prescribing a drug and bland diet.

Since she vomited again the next day, they took her back to the hospital, where it was then discovered that she was suffering from intestinal obstruction, which was the cause of her death.

The Chamber indicates that there was no medical malpractice in the care provided to the minor, but there was a loss of opportunity, since it would have been advisable to obtain the opinion of the pediatrician who, moreover, had treated her in the same hospital some time before when she suffered a gastroenteritis.

And he adds that the surgical intervention that in another situation would have been carried out was not carried out due to the poor evolution of the girl’s health.

Finally, the TSJRM, when setting the compensation at an amount lower than that claimed, takes into account the high mortality rate produced by the pathology that caused the death of the little girl.
