ECJ-decision: No compensation for flight delay due to wreck

In the event of delays or cancellations of subsequent flights due to a rampaging passenger can be exempt airlines following a ruling by the European court of justice from the obligation to pay Compensation. Under certain conditions, the disruptive behaviour of a passenger, could constitute an “exceptional circumstance”, decided the judges in Luxembourg on Thursday (case C-74/19).

the Background is a case in Portugal, where a passenger requests due to large compensation for delay of a carrier. The airline relies, however, that in this case, the “exceptional circumstances” was, and you had to pay, therefore, no compensation. The reason for the delay was that the machine had to be because of a rampaging passenger on the previous flight, unplanned land.

The Luxembourg judges in support of that argument now. Do not stress however, that this is true, if the society itself contributed to the behavior of the passenger, or there had been before the Boarding signs. In addition, they all must use their available funds to allow for earlier promotion.
