The Central Administrative Court of Contractual Resources (TACRC) has resolved that the filing of appeals for the award of Imserso trips for the 2023-2024 season “produces the automatic suspension of the processing of the contracting file, in accordance with the provisions in article 53 of the LCSP”.

Mundiplan, Seniorplan/Nautalia and Soltour presented allegations to the award by the Institute for the Elderly and Social Services (Imserso) of the three lots into which the competition is divided to Ávoris Corporación Empresarial.

The court had a period of five days after the presentation of the allegations to “resolve whether or not to maintain the automatic suspension in cases in which it had occurred,” according to ‘The resolution of adoption of precautionary measures’ of the General Secretary of TACRC published on the State contracting platform.

According to the document, the analysis of the reasons underlying the filing of the aforementioned appeals “shows that the damages that could arise from lifting the suspension are difficult or impossible to repair, so maintenance should be agreed upon.”

Given the applicable legal precepts, the court resolves to “maintain the suspension of lots 1, 2 and 3 of the contracting file, produced as a consequence of the provisions of article 53 of the LCSP, so that, as established in the “Article 57.3 of the cited text, the resolution of the appeals will decide the lifting.”
