Spain The Court orders the "immediate" extradition of 'Pollo' Carvajal to the US after rejecting his appeal in Strasbourg

The National Court has ordered Interpol to hand over “immediately” Hugo el Pollo Carvajal to the US authorities. The resolution of the Chamber comes after knowing the decision of the European Court of Human Rights (ECHR) not to admit the demand of the former head of the military intelligence service of Venezuela.

Once the precautionary measure that prevented the surrender agreed by the European court was lifted while it was studying the lawsuit, the Third Section urges Interpol to execute the decision of the Plenary Court to access extradition for drug trafficking crimes.

The Chamber orders that this resolution be communicated to the Embassy of the United States in Spain and to the director of the penitentiary center where the defendant is incarcerated. El Pollo Carvajal hid from Justice when the Plenary rectified the initial refusal to hand him over. After almost two years in hiding, he was located by the Police and since then he has been in provisional prison.

It is not the first time that the Third Section has ordered the immediate surrender, but the defense of the Venezuelan military has always managed to block it, either through criminal proceedings or through administrative litigation.

The Venezuelan defense indicates that there are three requests for precautionary measures to prevent extradition, two in the High Court and one in the Supreme Court, all three through contentious-administrative channels.
