The Public Ministry has requested Judge Joaquín Gadea to adopt the precautionary measure for the crimes of terrorist murder, an attempted crime of terrorist murder and a crime of terrorist injuries. He has done so after Kanza has appeared at the National Court and given a statement in an investigation that is secret.

The Prosecutor’s Office considers that if he were released provisionally there would be a risk that the Moroccan would flee from Justice. The Public Prosecutor’s Office also considers that prison should be ordered to avoid hiding sources of evidence and given the risk that he could commit other criminal acts.

Kanza was arrested on Wednesday after killing the sacristan of the Nuestra Señora de La Palma church, Diego Valencia, and injuring three other people. The Police requested the extension of police detention up to the legal maximum of five days, which expired this Monday.

Both the Police and the judge in their first resolutions on the case, as now the Prosecutor’s Office in its prison request, consider the attack as a terrorist attack of a jihadist nature with which he wanted to “disturb public peace by carrying out acts of terror , which could have motivated criminal action”.

In the resolution authorizing the search of Kanza’s home, the judge indicated that the Moroccan entered the church of San Isidro de Algeciras, where he argued “vehemently that the only religion to be followed is the Islamic religion.” He left “uttering messages in Arabic whose content is unknown” and returned a little later.
