Tesla CEO Elon Musk’s $56 billion pay package is currently undergoing a decision process that will be finalized before the end of the year. Delaware Court of Chancery Chancellor Kathaleen McCormick recently announced that she will determine whether Musk should receive this substantial sum by the time 2025 arrives.

Earlier this year, McCormick ruled that the massive pay package was excessive and unfair to Tesla shareholders. Despite Musk meeting certain criteria within the pay package that entitled him to the sum, McCormick intervened and prevented him from accessing the funds.

Tesla shareholders had previously approved the pay package in a vote, but after the court’s decision, they had to vote on it again in January 2024. Once more, shareholders showed their support for awarding Musk the $56 billion.

Now, McCormick will once again have the final say on whether Musk will receive the money. Additionally, she will consider the request from the shareholder’s lawyers who are seeking $1 billion in legal fees from Musk, to be paid in either cash or stock.

Despite the shareholders’ overwhelming approval of Musk’s pay package, there is uncertainty about whether Musk will accept it. Tesla Board Chair Robyn Denholm mentioned that Musk might explore other opportunities if the pay package is not approved. This raises questions about Musk’s potential focus on his other projects, even though he is nearing the launch of the Robotaxi in the near future.

The decision regarding Musk’s $56 billion pay package is crucial not only for Tesla but also for the future endeavors of its CEO. As the situation unfolds, it remains to be seen whether Musk will ultimately accept the massive sum or pursue alternative opportunities that may require his attention.
