Würzburg (dpa / lby) – In the revision procedure for the violent death of a baby in Lower Franconia, the pleas could be spoken today at 9 a.m. The verdict against the 25-year-old defendant, who has to answer to the district court of Würzburg, is also conceivable. After examining the case, the Federal Court of Justice found that it had not been clarified with certainty whether the accused had deliberately killed the baby – so perhaps there was murder instead of manslaughter. After the new hearing of evidence, it is now up to the 8th criminal division to decide this.
In the first instance, the man was sentenced to eleven years in prison for manslaughter on February 22, 2021. The German is said to have abused and suffocated his girlfriend’s eight-month-old boy shortly before Christmas 2019 in the Gemünden am Main area because he felt disturbed by the child. The defendant has always denied this. After taking the evidence, the district court assumed that the suspect had severely abused the boy several times in the weeks before his death.
