The prosecutors specialized in hatred crimes have been pursuing the vision for years to deepen in an area that has its main obstacle in the infardennity.

They pursue a specific regulation – in the form of integral law or, failing that, of exclusive provisions – which promotes the awareness and training of all the legal operators that intervene, from judges and the tax themselves to the technicians, so that these crimes
They are processed correctly.

Only in this way, they reiterate, there will be a more effective response to matters that, on occasion, are engulfed in the moving sands of ambiguity.
That hate crimes are not confused with others and terminate blurred in ordinary courts has become almost a priority.
On many occasions, it is sentenced as injuries and threats – times typified as mild – because it is not detected that the germ that has caused them is hatred and the victim is then unprotected.

This circumstance also entails that they are not accounted for in statistics.
“It would be very good that there was a regulation, a transversal formation of the subject to detect and process these crimes such as what they truly are”, Razona Susana Gisbert, Prosecutor of Degree of Hate of Valencia.
From her experience, she tells how, sometimes, hatred is processed as a slight offense to which the consideration of what truly is.

«The crimes of hate are the new gender violence, I always say it.
In them we still have to travel the same path as since 2003, when the rules of regulations were seated, “he adds.
And he does it from knowledge because until he arrived in this department in 2015, he was a fiscal of violence on women.

One of the pretensions, such as GISBERT, is to make victims have a protection of the same style as gender violence.
A foreign person harassed by the origin of it and that is in Spain in an irregular situation has very difficult to file a complaint for fear of being expelled.

The same happens with an indigent or someone violated by his homosexuality that does not want his condition to light.
«It is necessary to guarantee protection and anonymity when it comes to denouncing and going to trial.
In addition, visual confrontation with the aggressor should also be avoided.
Things that, for example, in gender violence we have clear but that in hate crimes, not yet. ”

The General Prosecutor’s Office has established as “priority” to promote specialization in this area.
In fact, Dolores Delgado is committed to “strengthening and enhancing” this prosecution.
In the memories of the Public Prosecutor’s Office of the last years there is the need to create specific mechanisms to address hate crimes.

The Ministry of the Interior, on the same line, committed last September to create in the National Police and in the Civil Guard specific groups to pursue this type of situations, in the central and provincial information units.
He also announced the development of tools to evaluate the risk of victims, as with macho violence as well as improving the training of police and civilian guard in this matter.

INTERIOR also announced its intention to strengthen the coordination mechanisms between the different security forces and bodies of the State and improve, in this way, the prevention of this type of crime.
