WASHINGTON (AP) — The Supreme Court on Monday rejected an appeal by a retired federal law enforcement officer that had been set in a chokehold and wrestled to the floor in a VA hospital safety checkpoint.

The justices did not comment in refusing to reestablish a lawsuit filed by Jose Oliva, 76, against three officers that violently arrested him in an altercation which had been captured on camera.

A Vietnam veteran who spent 25 years in national law enforcement, Oliva had a scheduled appointment for dental job in the VA center in 2016. The officials stated he didn’t make identification, which Oliva stated he previously had placed in a bin which was going to be renamed.

He underwent shoulder surgery and cure because of his throat, ear and hand following the altercation.

A trial judge permitted his civil rights litigation to proceed, but a federal appeals panel reversed the first judgment.
