Munich / Ansbach (dpa / lby) – According to its own statements, the Bavarian state parliament AfD is suing against new rules for the Administrative Court (VGH) in the Free State. The change in the law that came into force at the beginning of May stipulates that there should be “at least six” court senates at the VGH branch office in Ansbach – which the AfD considers a violation of federal law. There it is “clearly” required that the number of senates that are transferred to a branch office “must be clearly determined,” said the legal policy spokesman for the state parliament AfD, Christoph Maier.

The corresponding federal law, the Administrative Court Code, provides that the states can make the establishment of “individual senates” in other places possible by changing the law. The state government has now authorized itself to move senates to Ansbach “at will”, said Maier. The VGH headquarters is in Munich.

“Basically, there is nothing wrong with increasing the number of senates at the Administrative Court,” said the AfD MP. “However, the applicable law must be adhered to, which the state government is apparently not able to do.”

The AfD state parliament announced that it had filed the lawsuit with the Bavarian Constitutional Court. It was initially unclear on Friday whether this had already been received there. The court could not initially be reached for confirmation.
