The Pontevedra Court has sentenced a teacher from a Pontevedra study academy to two years in prison who kissed a 15-year-old student on several occasions on the mouth without her consent.
The court considers him the perpetrator of a continuing crime of sexual assault and, in addition to the prison sentence, has disqualified him from working as a teacher for two years and has imposed a three-year restraining order on the victim.
Furthermore, the judges of the Fourth Section of the Pontevedra Court have decided to disqualify him for seven years from any profession, trade or activities, whether paid or not, that entail regular and direct contact with minors.
The sentence handed down by the Superior Court of Justice of Galicia considers it proven that the accused sent the victim WhatsApp messages of sexual content and, in September 2019, waited for her with a candy in his mouth, at the exit of the elevator. the academy, “giving him a kiss on the mouth” without consent.
The judges assure that, on another occasion, he went to the minor’s home, offered her coffee and some sweets, grabbed her by the shoulders and, without her consent, kissed her on the mouth.
These episodes were repeated in November 2019 when both were left alone at the academy and the teacher grabbed her face and gave her, without her consent, two kisses on the mouth; or going down the elevator together, holding her against the wall.
Another day, “within that period and close to the previous ones,” according to the court, he again took advantage of the fact that they were alone in the academy to enter the classroom where the victim was and, surprisingly, kiss her on the mouth, also without her consent. .
The judges consider that there is “abundant” documentary evidence that demonstrates conduct by the accused “that does not fit into the teacher-student relationship and that is not presented as the same, or at least similar, to that which the accused had with the rest of the students.” “
