Frankfurt/Main (dpa/lhe) – A plaintiff from Hesse gets back his lost gambling stakes of a good 10,000 euros after a decision by the Frankfurt Higher Regional Court. The reason given by the court on Thursday was that the online gambling operator based in Malta had no license for gambling in Hesse in the period in question between February and May 2017. Therefore, the plaintiff could demand the return of the money because the ban on organizing public games of chance on the Internet had been violated.
This confirmed a previous judgment of the district court in Giessen. The decision is now final (Az. 23 U 55/21).
