Carles Puigdemont wants the Supreme Court judge to formally suspend the Euroorden against him.
This is how it follows from the writing directed on Monday to the Instructor of Procés, Pablo Llarena, who asked about his reaction to the last decision of the EU General Court on the immunity of the former President.
In a resolution last Friday, the Vice President of the European Court rejected the petition of the Puigdemont to reactivate his immunity as Europariamentary until the question was resolved on the Euro-orders raised by Llarena.
He considered that the measure was unnecessary in interpreting that the interposition of the prejudicial question meant the suspension of the Euro-orders.
The request to accurately reactivate the immunity that the Eurocámber was withdrawn was raised after Italy, despite the existence of the question, stopped Puigdemont upon arrival in Cagliari.
Finally, the Italian court considered that the Euroorden was suspended, but what happened revealed that in the computers of the Schengen Puigdemont system was still appearing as claimed.
In his writing, the defense of Puigdemont and former Consellers Clara PonSatí, Lluís Puig and Toni Comín asks the magistrate to report on whether, “under the consequences […] referred to as the Vice President of the General Court
of the European Union in its Auto of November 26, 2021, by the Hon. Magistrate Instructor, in accordance with the principle of loyal cooperation, the appropriate instructions have been issued to make effective the suspension of this criminal proceedings for all purposes ”
.
The request is addressed “especially” to the relative “to the different arrest warrants issued in this criminal case, communicating this suspension to the different security forces and bodies, as well as the Schengen and Interpol information system.”
The three fugitives also claim that they are a copy of the notifications that LLULARA “by virtue of this suspension and in accordance with the principle of loyal cooperation, have been made to the State Security Forces and Bodies, the Schengen Information System
and Interpol, in relation to the suspension of these orders. ”
