Leipzig (dpa/lsw) – In the appeal proceedings for the remediation of contaminated sites at the former “Kesslergrube” landfill in Grenzach-Wyhlen, the oral hearing scheduled for Thursday (February 23) at the Federal Administrative Court in Leipzig has been cancelled. According to information on the court’s website, the appointment has been cancelled. Nothing is known about a new date.
The chemical group BASF is planning to rehabilitate part of the “Kesslergrube” in the district of Lörrach. Up until 1976, building rubble, household waste and waste from the chemical and pharmaceutical industries were disposed of there. BASF is responsible for a relatively large part of the area and is now relying on the encapsulation process: Thick walls that reach more than 30 meters deep into the earth are intended to seal off the portion of the landfill.
Because the technology is controversial, the municipality of Grenzach-Wyhlen took legal action against the project and lodged a complaint with the Federal Constitutional Court in the legal dispute. The environmental association BUND in the southwest also went to court. He calls for the pollutants to be completely removed from the former dump. According to the Federal Administrative Court, the appeal procedure could “contribute to clarifying the question of whether an action by a recognized environmental association against the declaration of binding nature of a remediation plan is permissible”.
