Munich (dpa / lby) – According to the Munich Administrative Court, the quarantine of a patient suffering from monkeypox is probably lawful. An infection does not require sexual contact, but can also happen through contact with contaminated objects, the court found in an urgent decision that was published on Thursday. Despite the heavy burden of being isolated at home, the protection of the health of the population prevails.
With its decision (file number: M 26b S 22.3317), the court rejected the urgent application of a man with which he wanted to defend himself against the quarantine ordered by the health department. Accordingly, he is not allowed to leave his apartment during this time without the express consent of the health department. The chamber did not object to the period of 21 days. The decision made on Wednesday is not yet final.
The plaintiff had argued that an infection with monkeypox is only transmitted through same-sex intercourse between men. The court did not follow that. The disease is neither limited to men nor does it require sexual contact. The Chamber also referred to the assessment of the Robert Koch Institute (RKI) that there is a risk of a severe course in newborns, children, pregnant women, the elderly and those with weakened immune systems.
