A monthly price of 8.99 euros for a basic Bank account at Deutsche Bank is too high. The Federal court of justice (BGH) ruled on Tuesday that the pay clauses are for such an account is ineffective. The fees were therefore not appropriate. Thus, a complaint by the consumer was Central Federal Association (vzbv) also in front of the highest German civil court in Karlsruhe successfully. (Az. XI ZR 119/19)
The consumer advocates had turned against the basic monthly price of 8.99 euros and an additional fee of 1,50 Euro per Transfer by an employee on the phone or in the store. Before the regional court and the higher regional court (OLG) Frankfurt am Main, the action was successful. The BGH has now rejected also by the German Bank-imposed Revision.
The fee clauses were a control and were therefore ineffective, said the Federal court. In accordance with the statutory requirements, the fees for basic account functions such as deposits and withdrawals or Transfers would have to be reasonable. This should be taken into account that a basic payment account “should in particular also enable low-income consumers with access to a payment account”.
The Deutsche Bank had breached the guidelines, because you’ve allocated in the calculation of the remuneration of the management of basic accounts related overhead alone on the holder of such an account.
